General Terms and Conditions of Sale (GTC)
1. Presentation of the Establishment
These General Terms and Conditions of Sale (hereinafter referred to as the “GTC”) apply to all services and sales offered by La Pointe du Paradis, a Beauty, Wellness & Sport Center.
Any appointment booking, purchase of services, packages, gift vouchers or products implies full and unconditional acceptance of these GTC.
2. Services and Products
The Center offers wellness, aesthetic and body treatments, as well as related products.
Descriptions presented on the website are provided for informational purposes only and are not contractual.
3. Appointment Booking
Appointments may be booked online, by phone or directly on site. All bookings are personal and nominative.
The Center reserves the right to refuse or cancel an appointment in the event of non-compliance with these GTC.
4. Delays, Cancellations and No-Shows
Any delay may result in a reduction of the treatment duration without any price adjustment.
Any cancellation or modification of an appointment must be made at least 24 hours in advance.
Failing this, the Center reserves the right to charge all or part of the service, in accordance with Article L221-28 of the French Consumer Code, relating to services provided on a specific date or during a specified period.
In the event of a no-show without prior cancellation, the service shall be considered due.
5. Prices and Payment Terms
Prices are indicated in euros, all taxes included, in accordance with Articles L112-1 et seq. of the French Consumer Code.
Accepted payment methods are credit/debit cards and cash.
Card payments are secured through approved payment service providers and comply with current security standards.
In accordance with Article L133-4 of the French Monetary and Financial Code, the Center does not store any banking data and does not have access to clients’ confidential payment information.
6. Packages and Accompaniment Programs
All packages and accompaniment programs offered by the Center are strictly personal, nominative and non-transferable.
They may not be shared or transferred to a third party, except with prior written and exceptional approval from the Center.
Accompaniment programs include several sessions, stages or services defined in a contract or quotation signed by the client at the time of purchase.
Any modification to the content of the accompaniment program is subject to validation by the Center.
Packages are neither exchangeable nor refundable, except where legally required.
7. Gift Vouchers
Gift vouchers are valid for six (6) months from the date of purchase, unless otherwise stated.
They may be used for all services and products offered by the Center.
Gift vouchers are nominative, non-refundable and cannot give rise to any cash refund, even partially.
8. Contraindications and Liability
Clients undertake to inform the Center’s staff of any medical contraindications, pregnancy, pathology or ongoing medical treatment.
The Center cannot be held liable for damages resulting from incomplete or incorrect information provided by the client.
9. Personal Data and GDPR
The Center collects and processes clients’ personal data in accordance with Regulation (EU) 2016/679 of April 27, 2016 (GDPR) and French Law No. 78-17 of January 6, 1978, as amended.
The personal data collected (identity, contact details, appointment history, billing information) are strictly necessary for:

the performance of the contract (Article 6.1.b GDPR),

compliance with legal and accounting obligations (Article 6.1.c GDPR),

and, where applicable, the client’s consent (Article 6.1.a GDPR).
In accordance with Articles 12 to 22 of the GDPR, clients have the right to access, rectify, erase, restrict processing, object to processing and request portability of their personal data.
Data are retained only for the period strictly necessary for the purposes pursued and legal obligations.
No personal data are sold or transferred to third parties without the client’s explicit consent.
10. Intellectual Property
All content on the website (texts, images, logos, concepts, names) is protected by intellectual property law.
Any reproduction or use without prior authorization is strictly prohibited.
11. Complaints, Right of Withdrawal and Mediation
The client has a fourteen (14)-day period from the conclusion of the contract or the purchase of a service or product to exercise the right of withdrawal, without having to justify the decision or bear any costs other than those provided for by law.
Any complaint must be submitted in writing to the Center.
In accordance with applicable legislation, the client may resort free of charge to a consumer mediation service in the event of an unresolved dispute.
12. Applicable Law and Online Dispute Resolution
Any consumer who encounters a dispute with a company located within the European Union may submit a mediation request via the European Online Dispute Resolution (ODR) platform:

These GTC are governed by French law.
In the event of a dispute, French courts shall have exclusive jurisdiction.
